Should arbitrators be licensed or “professionalized”?
January 1, 1976
The arguments for and against professionalizing or licensing arbitrators, or requiring them to hold law degrees from accredited institutions are presented. The author, who does not use statistical data, reasons that neither requirement is necessary. He likens arbitration to an art form in which opposing parties trust in the arbitrator to interpret fairly the web of rules and terms of agreements that constitute “industrial jurisprudence.”
